Yes Talk to a lawyer. It's not like the house burned down.$2500 is nothing to them. Plus they don't want to have any bad publicity with their name attached to it.

yeah I think tomorrow, that will be on the agenda. I will give them an opportunity to do the right thing first then I will call a lawyer...
I just remembered that this is the second thermostat they put in too because the first one malfunctioned. Not in the same way but it still malfunctioned 1 week after the system was put in. I think this thing is just plane defective...
Anyway thanks for the encouragement. I think thats what I needed most..

I'm not an attorney, but I would guess that what you pay one to bring a suit against the company will be more than the cost of what you lost. Big companies have lawyers on retainer to fight off lawsuits. Normal everyday people like ourselves do not. Although I feel bad for you, the mindset of bringing litigation for everything that goes wrong is not beneficial to anyone and all too common in this country.

I am in the construction business and I pay alot of money for my insurance and work comp. I agree litigation for blatent irresponsibility on the part of the consumer is assanign. I hate it and I can't agree with you more. On the other hand, as a contractor if I burn somebodies house down or the bathroom that I remodel ends up flooding there house I am responsible and should do the honorable thing without them having to sue me. Unfortunately, in this day in age a mans word isn't worth a you know what so will they do the right thing? I payed $12,500 for the top of the line amana products that are in my home. I payed it gladly with the belief that I had the best i could buy. So I ask you, do they have an obligation as I do, to stand behind there product if it doesn't perform the way they promised?
I don't know the answer to that, I just know how I feel and maybe I will feel better about it tomorrow. But don't confuse this situation with me spilling hot coffee on myself and suing McDonalds... I don't think they are even in the same ball park...

Donny, I didn't mean to imply that your case is frivolous. We all mourn your loss and I don't feel like you're trying to turn your accident into a "winning ticket". My only point is that it would cost you more money to pursue the matter in court than what you could reasonably expect to win (should you win). In other words, it would be a "no win" law suit regardless of the outcome. To be the devil's advocate, as you are in the construction business, I'm sure you know that manufacturers will try to pass the buck onto whoever installed their system - claiming that a faulty installation led to the failure. I do hope that you will feel better about the whole situation, if it were me, it would probably take a week or two before it feels any better, so I definitely understand the anger. But sometimes when we're angry is the worst time to make decisions like this.

Ok update... Talked to my ac guy this morning and you were right Hoang, they aren't responsible for things in the house unless it was designed and signed off by an engineer for a specific temp range. So gonna check on homeowners ins. see if they can help some. I have 1k deductible though so we'll see.
Anyway several people have offered some corals and I just want to say how much I appreciate it! I can't tell you enough how much it means to me and my wife.
I especially wanted to thank Eric!!! This guy just amazed me! He doesn't even know me and immediately sent me a care package from Missouri!!! This is the kind of person makes you want to be more giving and I hope I can be as much of a giver as him in this comming year...

Let me know how everything looks when it gets there. This is my first time shipping anything like this. Packaged pretty well. My only concern would be the bags. I had some corals shipped to me the same way though, so they should be fine. They are in a good shipping cooler and two small boot heaters are on the opposite end of the cooler.
Enjoy! Feels good to start the new year off helping fellow reefers!

Update:
Homeowners Ins doesn't cover anything alive... So I guess thats that.
On a good note just recieved some nice frags from eric and its sooo nice to have a few things going again. Thanks eric!
Several others have offered a few things and I'm sure my reef will be back on its feet in no time thanks to some really nice people.
Oh and I talked to the my AC guy and he's coming to put a whole new digital touch screen setup in and said he would check everything else out.
So the moral of the story, have somebody check your tank every day not every other day....
