I think the McDonalds lady was full of *** along with the rest of the sue happy world. But I would be pretty traumatized by bleeding whilst surrounded by sharks. PTSD makes ya lose sleep, and stop functioning. No I don't have it, lol. But I can see where that happening would be big time stressful, with many bad dreams to follow. I had bad dreams just from watching Jaws when it first came out, and honest to God, didn't want to go in the ocean past my knees for yrs. (yea yea go ahead and mock me). Now you see these surfers with arms bit off.... This lady didn't do anything to take responsibility for, and I don't know if she is capitalizing on this or not....but I can see PTSD happening in THIS case.

I have post traumatic stress from a falling pipe wrench. Wonder if I can sue the manufacturer of the wrench. Or, or, perhaps I could sue Sir Isac Newton for discorvering gravity in the first place. Without gravity that wrench would have never fallen right???? Seriously though it is a load of crap. I was shot three times in Iraq the first time around and nearly blown to bits at the same time and I sleep fine at night. It's all about lazy people wanting easy money.

Must be very nice for you to be so strong, (no sarcasm intended). My husband did two tours in Nam, (volunteered for the second). He never talks about it, but for ten yrs afterwards he would try to get someone, out of the way of something, (in his SLEEP), in a way that traumatized everyone in our house... Yes, he was able to keep working. But some aren't. Ask the VA how many homeless guys are suffering from PTSD.

On the flip side. Yep, too many greedy people suing for stupid stuff. A neighbor sued us cause her kid got his arm broken playing airplane with other kids, in a totally different neighbors yard, she sued us both, and both home insurance companies settled with her...don't ask me why ours did, wasn't even in our yard, but they gave them $2000. and I have a claim on my record.

Legitamet cases of PTSD are to be taken vaery seriously. I am very lucky that I deal with stress very well. I am also greatfull to your husband for his service. I had nightmares and I was, and am still but to a lesser degree, very jumpy. But there is a difference between a crotch full of hot coffee or a ruptured fish tank and seeing ones friend and comrad in arms blown to bits in front of them. Sorry to take such a graffic turn but that's how I see it. Those Vets you speak of, most of them have seen a virtual hell on earth and they, if any, have the right to claim that PTSD has ruined there lives. As for the rest of the panseys who wanna sue the socks of the rest of the world for a minor fender bender, I say "suck it up".

I think shes entitled to compensation of some sort. I know i would be wanting something. Not millions, but something.

Poor sharks.. plus all the other fish that are kept with the sharks...

James i was thinking exactly the same thing, i live not far from Sydney yet i have never heard any mention of this.

Sydney has a great aquarium, i spent almost the whole day there last year, even my girlfriend loved it!!

I am getting some kind of stress reading all this. I don't know if i can go on, anyone know a good lawyer. My eyes are hurting real bad and the tips of my fingers are burning, my feet feel wet and my ears are ringing. and it is all because of this tread. I need a good lawyer.

I guess something that would help is to know is for how much she is wanting to sue. If it is just for maybe hospital bills of being cut, and temp substitute pay for any being unemployed due to, as someone pointed out (lack of sleep, jumpiness, etc.) then that is one thing. But if she is suing for hundreds and hundreds of thousands, then I would be more frustrated with her. So, since I don't know the whole store, I should digress.

And forgive, I think part of why I get so worked up with stuff like this is I am dealing with it right now. My gpa died 2 years ago (7 months after mom did). Well, Gpa's girlfriend is claiming she was his common law wife, and produced this "document" with all sorts of claims that Gpa supposedly signed. (Our people say it is a copied signature). But anyway, we have been spending money to fight her for 2 years now. Since she is claiming to be the common law wife, she is saying SHE should be getting the estate, all the money, etc, and his own kids (and me) get zip, zilch, zero, nada.

We have an actual court date set now for the end of this month. We are hoping that a judge and jury will finally put an end to all this. Esp how, on file no less, his girlfriend has changed her story more then once, that goes in our favor. But..none the less. I think this is partly why I get so worked up about stupid lawsuits. *takes a deeeeeep breath*

Interesting legal issues. I don't know much about Aussie law, but here, business owners owe a duty of care to patrons but there has to be shown the owner knew, or should have known, of the dangerous condition before they can be liable. It is not a guarantee of safety but negligence has to be shown. I suspect the real lawsuit could be products liability against the manufacturer of the tank.
Certainly, the lady should be compensated for her injuries but suing for millions??? I suspect the real 'shark attack' is by the lawyers!!

I think Dick has touched on a few important issues, that was hopefully an unforceable accident, if there was an existing problem that was known of and covered up, then someones in big trouble.
Its a 61 yr old woman who was attacked by an aquarium through no fault of her own. I suspect that she will suffer alot of distress over that. People deal with stress differently, so what works for one can't always be used as a yard stick to determine others stress.
I abhor the sue at the drop of a hat mentality, but I suspect that she may be due some compensation, BUT keep in mind you are basing your opinions on a short piece of writing designed to hook, shock, and entertain you. There is no doubt a whole lot to the story as yet untold
